The outside circumference where that seal mounts looks solid. I'd clean up the gouges a bit and install the new seal without worry.

Should there be fluid seeping or do I need to attach the yoke first before filling the t-case?

Install the yoke first. You can see that the fluid level is flowing over the seal because you don't have the corresponding piece installed to block the fluid.
