I would spend the $5 each because I'm paranoid.

Too many lawsuits.

A bolt rated the same or higher would work but the length has to be correct.
You don't want any side loads on the threads. As long as the shank of the bolt is the only part seeing load you're probably fine.

Are you sure about the rated same or higher, a 12.9 bolt.. would that be too brittle?

Just googled it, apparently 12.9 would be great. Also make sure you do grade 8 SAE and not a metric 8.8 which is basically grade 5 sae

Just pony up and buy the correct strength bolt. A grade 8 from a hardware store is not going to have the same strength required for a leaf spring that a 12.9 would, and then you're spending right around $5/bolt anyway.
