Yes I do have to be aware with emissions. Does anyone know if I can run without an erg valve in New York?

Technically you cannot remove, tamper with, or defeat any emissions equipment that was mandated to be installed in an emissions controlled vehicle. So the short answer is no, not legally.

And you can install whatever you want, and it will run. But you will need a separate transmission controller. You may also lose certain gauge/warning light functions.
